Please read these terms carefully before using MenuCraft. By creating an account or using the platform, you agree to be bound by these Terms and Conditions in their entirety.

In accordance with Article 6 of French Law No. 2004-575 of 21 June 2004 (Loi pour la Confiance dans l'Économie Numérique — LCEN), users of the website menucraft.digital are hereby informed of the following:

2. Acceptance of Terms
By accessing or using MenuCraft (the "Service") at menucraft.digital, operated by E Social Media ("we", "us", "our"), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
If you do not agree to these Terms in full, you must not use the Service. We reserve the right to update these Terms at any time by posting the revised version on this page. Continued use of the Service after any changes constitutes your acceptance of the updated Terms.
3. Description of Service
MenuCraft is a SaaS (Software-as-a-Service) platform that enables businesses — including restaurants, cafés, hotels, beauty salons, and other service providers — to create, customize, and publish digital menus and catalogs accessible via a unique URL or QR code.
The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
4. Accounts & Registration
To use MenuCraft, you must create an account by providing accurate, complete, and up-to-date information. You are solely responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access or security breach at support@menucraft.digital
You must be at least 18 years old and legally authorized to enter into binding contracts to register. One person or business entity may not maintain more than one free account.
5. Subscription Plans & Billing
MenuCraft offers both a free plan and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually, depending on your selection) and processed securely via Stripe, our third-party payment provider.
- Subscriptions renew automatically at the end of each billing period unless cancelled beforehand
- You may cancel your subscription at any time from your account dashboard
- Upon cancellation, you retain access to paid features until the end of the current paid billing period
- Prices are displayed in the currency shown at checkout and may be subject to applicable local taxes (VAT)
- We reserve the right to change subscription pricing with at least 30 days' prior notice
6. No-Refund Policy
All payments to MenuCraft are strictly non-refundable. By subscribing to a paid plan, you acknowledge and agree to this policy without exception.
Before subscribing, you have full access to evaluate the Service through our free plan and our live theme demo. This gives you everything you need to make an informed decision prior to any payment.
Non-refundable situations include, but are not limited to:
- Unused time remaining in a billing period after cancellation
- Accidental purchases or plan upgrades
- Dissatisfaction with features or the platform
- Failure to cancel before an automatic renewal
- Change of business circumstances
The sole exception to this policy is in the event of a documented billing error or duplicate charge caused by a technical fault on our side. In such cases, contact us within 7 days of the charge at support@menucraft.digital with your account email and transaction reference. Any decision to issue a credit or correction remains at our sole discretion.

7. Your Content
You retain full ownership of all content you upload or create on MenuCraft, including menu items, descriptions, images, logos, and business information ("Your Content"). By using the Service, you grant E Social Media a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely for the purpose of providing and operating the Service.
You are solely responsible for ensuring that Your Content:
- Does not infringe any third-party intellectual property rights
- Is accurate and not misleading to end users
- Complies with all applicable laws and regulations
- Does not contain illegal, offensive, or harmful material
8. Intellectual Property
All intellectual property rights in the MenuCraft platform — including its source code, design, themes, trademarks, and branding — are the exclusive property of E Social Media. Nothing in these Terms grants you any rights in the platform beyond the limited right to use the Service as described herein.
You may not copy, reproduce, distribute, reverse-engineer, or create derivative works of any part of the platform without our prior written consent.
9. Prohibited Uses
You agree not to use MenuCraft to:
- Publish false, misleading, deceptive, or fraudulent content
- Violate any applicable French, European, or international law or regulation
- Attempt to gain unauthorized access to our systems, databases, or user accounts
- Transmit malicious code, spam, or automated queries that overload our infrastructure
- Resell, sublicense, or white-label access to the Service without prior written consent
- Use the platform for any purpose that competes directly with MenuCraft
Violation of these prohibitions may result in immediate account termination without refund.
10. Termination
Either party may terminate the relationship at any time. You may close your account by contacting us at support@menucraft.digital. Upon deletion, your data will be handled as described in our Privacy Policy.
We reserve the right to suspend or permanently terminate your account, without prior notice, if we reasonably believe you have violated these Terms. No refund will be issued upon termination for cause.
11. Limitation of Liability
To the maximum extent permitted by French law, E Social Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, data, business opportunities, or goodwill.
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Our aggregate liability to you for any claim arising from your use of the Service shall not exceed the total amount paid by you to MenuCraft in the three (3) months preceding the claim.
12. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of France.
If you are a consumer resident in the European Union, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
